1. Digital Print Licensing Terms

All colourised and digitally enhanced files sold on this website represent proprietary derivative creative works. While the underlying original black-and-white negatives are out of copyright and in the public domain, the specific restoration, colouring, and digital enhancement layers are copyrighted by Mosman Heritage Gallery.

Personal Use License

With each purchase, you are granted a non-exclusive, non-transferable, perpetual license to use the file under the following conditions:

You may print the image for home, office, or individual display.
You may crop or resize the file to fit custom frames.
You may use the image as a personal desktop/mobile background.

Prohibited Uses

You may not resell, redistribute, or license the digital file to any third party.
You may not print and sell physical copies of the print commercially.
You may not use the colourised file in commercial merchandise, book covers, advertising campaigns, or website templates without acquiring an explicit Commercial License.

2. Terms of Service

By accessing this site and purchasing digital media, you agree to comply with our Terms of Service.

Digital Delivery

Digital copy JPEGs are compiled and verified server-side. Delivery occurs automatically via web redirection and email links. It is your responsibility to provide an accurate email address at checkout.

System Misuse

Any attempts to bypass watermarks, tamper with EXIF signatures, or gain unauthorized access to the merchant database will result in immediate cancellation of access tokens and/or legal actions.

3. Privacy Policy

Your privacy is important to us. This policy details how we handle transaction data.

Information We Collect

Email Address: Used solely to deliver download links and secure transaction logs.
Transaction Data: Payment details are securely processed directly by Stripe. We do not store your credit card or raw banking details on our database.
Telemetry logs: IP-free logs regarding button clicks and filtering selections to optimize layout.

Data Governance

We do not sell, rent, or trade your email address or transaction history to any marketing lists or third parties.

4. Refund Policy

Due to the nature of digital goods, all sales of colourised photographs are final once the clean download link is released.

Exceptions

Technical corruption: If the file does not download correctly, is corrupted, or fails to open, contact us with your Transaction Session ID. We will issue a replacement link or manual file delivery.
Double purchases: If you accidentally purchase the same image twice in separate sessions, we will refund the duplicate charge.
